Rapture Tour Terms and Conditions

By booking a tour with Rapture, you agree to the following terms and conditions. These terms ensure a fair, transparent, and safe experience for all parties involved. If you have any questions or concerns, please contact us prior to booking.

Payment Policy

  1. Deposits and Final Payments:

    • A $1,000 non-refundable deposit and a completed Health and Safety Waiver are required to secure your booking.

    • The full balance of the tour price is due 90 days (or three months) prior to the tour departure date. Timely payment is the participant’s responsibility.

  2. Payment Methods:

    • Payments are accepted in Australian dollars (AUD) via:

      • Direct deposit to our Commonwealth Bank account:

        • BSB: 067 - 873

        • Account: 1493 - 3219

      • Credit card (Visa or Mastercard). Note: A 1.75% surcharge applies to domestic cards, and a 2.9% surcharge applies to international cards. This surcharge is non-refundable.

  3. Late Payments:

    • Failure to pay the full balance on time will result in the loss of your deposit.

    • If the balance remains unpaid within 90 days of departure, all funds paid to Rapture will be forfeited, and your booking may be canceled.

  4. Payment Plans:

    • Payment plans may be available upon request. Contact us to discuss options.

Cancellation Policy

  1. Customer-Initiated Cancellations:

    • Cancellations must be made in writing via email.

    • Cancellation fees apply based on the notification date:

      • 3+ months before departure: Forfeit the $1,000 deposit.

      • Less than 3 months before departure: Forfeit the full tour price (or all payments received if on a payment plan).

    • If Rapture fills your spot, you’ll receive a full refund.

  2. Rapture-Initiated Cancellations:

    • Rapture reserves the right to cancel tours due to insufficient numbers, unsafe conditions, or force majeure events (see below).

    • In these cases:

      • We’ll endeavor to find an alternative tour.

      • If no alternative is available, a full refund minus any non-recoverable booking fees will be issued.

  3. Force Majeure:

    • Rapture is not liable for cancellations, delays, or changes due to events outside our control, including but not limited to:

      • Extreme weather

      • Government restrictions

      • Natural disasters

      • Epidemics/pandemics

    • Customers are responsible for any additional costs incurred, such as flight changes or accommodation.

  4. Credits:

    • Credits issued due to cancellations are valid for three years from the date of issue and are transferable when approved by Rapture.

Health and Safety

  1. Fitness and Medical Conditions:

    • Customers must be medically fit to participate and disclose any pre-existing conditions.

    • Rapture may require a doctor’s certificate to confirm fitness for the tour.

    • Failure to disclose medical conditions may result in removal from the tour without refund.

  2. Injury or Illness During the Tour:

    • Customers must inform Rapture staff of any injury or illness immediately.

    • Medical treatment or evacuation will be arranged at the customer’s expense.

  3. Risk Acknowledgment:

    • Customers participate at their own risk. Activities like kitesurfing, wing foiling, snorkeling, and paddleboarding are high-risk sports.

    • By booking, you acknowledge and accept the inherent risks associated with these activities.

Liability

  1. Limitations of Liability:

    • Rapture is not liable for:

      • Injuries, loss, or damage sustained during the tour.

      • Loss, damage, or delays to personal property.

      • Costs incurred due to changes, cancellations, or delays caused by third parties.

  2. Customer Responsibility:

    • Customers are liable for damage caused to third parties, property, or equipment, whether accidental or intentional.

    • Customers agree to indemnify Rapture and its affiliates against any claims arising from their actions.

Tour Rules and Conduct

  1. General Rules:

    • Follow all instructions from Rapture staff and affiliates for your safety and the safety of others.

    • Alcohol consumption before water activities is strictly prohibited.

  2. No Dickhead Policy:

    • Disrespectful, vulgar, or unsafe behavior will result in removal from the tour without refund.

  3. Customer Removal:

    • Rapture reserves the right to refuse or remove participants due to:

      • Unsafe behavior

      • Intoxication

      • Failure to follow instructions

      • Physical or mental unfitness

Hire and Demo Equipment

  1. Equipment Use:

    • All equipment hired from Rapture must be returned in good condition.

    • Damaged or lost equipment will incur repair or replacement fees.

  2. Security Deposits:

    • A security deposit (e.g., driver’s license or credit card) may be required for equipment hire.

Travel Insurance

  • Customers are strongly encouraged to purchase comprehensive travel insurance covering:

    • Medical emergencies

    • Cancellations

    • Evacuations

    • Lost or damaged property

Final Acknowledgment
